The lawsuit was filed by Pennsylvania resident Tim Thomas, who accuses a waterways conservation officer of snooping around his lake house, harassing him and his wife, and issuing him bunk citations in 2023.<\/p>\n<p class=\"article-paragraph skip\">Thomas claims in <a href=\"https:\/\/ij.org\/wp-content\/uploads\/2024\/09\/ECF-1-Complaint.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">the lawsuit<\/a> that conservation officer Ty Moon conducted multiple unconstitutional searches at his lakeside cabin in Susquehanna that summer. He says that on two occasions, Moon entered his property without his or his wife\u2019s consent to search for evidence of potential fish and boat violations. Thomas also accuses Moon of harassing them and spying on them with binoculars from the other side of the lake. In both instances, Moon issued Thomas a citation, and each time, Thomas was vindicated and had the citations dropped.<\/p>\n<p class=\"article-paragraph skip\">\u201cTim faces a real and concrete threat that Defendants will enter and search the curtilage of his home in the future simply because the cabin has frontage on Butler Lake,\u201d the lawsuit reads. \u201cBecause Defendants\u2019 have entered and searched the curtilage of Tim\u2019s home without his consent or a warrant, and are empowered by [state law] to do so whenever they wish, Tim feels insecure on his own property even though he is following the law.\u201d\u00a0\u00a0\u00a0<\/p>\n<div class=\"lazied-youtube-frame\" data-video-id=\"YdiVtyq3Bfk\" data-iframe-classes=\"wp-embed-aspect-16-9 wp-has-aspect-ratio\">\n\t<\/p>\n<p>\t<svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" class=\"lazied-youtube-frame-icon\" viewbox=\"0 0 68 48\">\n\t\t<path d=\"M66.52 7.74c-.78-2.93-2.49-5.41-5.42-6.19C55.79.13 34 0 34 0S12.21.13 6.9 1.55c-2.93.78-4.63 3.26-5.42 6.19C.06 13.05 0 24 0 24s.06 10.95 1.48 16.26c.78 2.93 2.49 5.41 5.42 6.19C12.21 47.87 34 48 34 48s21.79-.13 27.1-1.55c2.93-.78 4.64-3.26 5.42-6.19C67.94 34.95 68 24 68 24s-.06-10.95-1.48-16.26z\" fill=\"red\"\/>\n\t\t<path d=\"M45 24 27 14v20\" fill=\"white\"\/>\n\t<\/svg>\n<\/div>\n<p><noscript><\/p>\n<p><\/noscript><\/p>\n<p class=\"article-paragraph skip\">Thomas is being represented in the suit by Kirby Thomas West, an attorney with the <a href=\"https:\/\/ij.org\/case\/pennsylvania-fish-cops\/\" target=\"_blank\" rel=\"noreferrer noopener\">Institute for Justice<\/a>. The public-interest law firm is currently litigating several other cases in multiple states as part of its <a href=\"https:\/\/ij.org\/issues\/ijs-project-on-the-4th-amendment\/?gad_source=1&amp;gclid=CjwKCAjw6c63BhAiEiwAF0EH1OimTkNq278htM4Irdnap92Fx3diOEkVebX_OmqsVThWcZAbgLjp6hoCUYwQAvD_BwE\" target=\"_blank\" rel=\"noreferrer noopener\">4th Amendment Project<\/a>. A few of these lawsuits deal specifically with state fish-and-game agencies, and they are based on claims that game wardens and fish cops have, at times, violated hunters\u2019 and anglers\u2019 Fourth Amendment rights against unlawful searches and seizures.<\/p>\n<p class=\"article-paragraph skip\"><strong>Read Next:<\/strong> <a href=\"https:\/\/www.outdoorlife.com\/hunting\/pennsylvania-drone-sting-conviction\/\" target=\"_blank\" rel=\"noreferrer noopener\">Man Convicted of Wildlife Crimes for Trying to Help Undercover Game Wardens Recover a Deer with His Drone<\/a><\/p>\n<p class=\"article-paragraph skip\">\u201cWhat we\u2019ve seen in recent years is a disconcerting erosion or lack of respect for Fourth Amendment Rights,\u201d West tells <em>Outdoor Life<\/em>. \u201cWe bring cases to try to bolster [those] rights, and we felt like this [case] fit pretty squarely within that project.\u201d<\/p>\n<p class=\"article-paragraph skip\">She explains that Thomas reached out to IJ about representation after seeing some of the firm\u2019s other legal wins under similar circumstances. One of these wins occurred in May, when <a href=\"https:\/\/www.outdoorlife.com\/conservation\/twra-warantless-searches-ruled-unconstitutional\/\" target=\"_blank\" rel=\"noreferrer noopener\">Tennessee judges reigned in the powers of state game wardens<\/a> by restricting their ability to enter private property to look for or investigate wildlife crimes without a warrant. That case was filed by two landowners who were also represented by IJ attorneys, and who claimed to have been under surveillance by wildlife officers with the Tennessee Wildlife Resources Agency.<\/p>\n<p class=\"article-paragraph skip\">West says their case in Tennessee \u2014 along with others filed by the IJ in Virginia, Louisiana, and Pennsylvania \u2014 challenged the <a href=\"https:\/\/www.law.cornell.edu\/wex\/open_field_doctrine\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cOpens Field Doctrine,\u201d<\/a> a federal precedent from the Prohibition era that permits law enforcement agents to surveil rural lands. TWRA attorneys argued in the case that because so much hunting takes place on private land in Tennessee, this exception to the constitutional protection against warrantless searches is necessary for the agency to protect the state\u2019s wildlife resources.<\/p>\n<p class=\"article-paragraph skip\">\u201cEssentially, the government tries to allege that there\u2019s an exception to the Fourth Amendment\u2019s warrant requirement on certain kinds of property. And we just think that is totally contrary to the Constitution,\u201d West says. \u201cBut in some ways, this case [involving Tim Thomas] is really distinct because we\u2019re talking about an even more blatant disregard for Fourth Amendment rights.\u201d<\/p>\n<p class=\"article-paragraph skip\"><strong>Read Next: <\/strong><a href=\"https:\/\/www.outdoorlife.com\/conservation\/game-wardens-body-cams\/\" target=\"_blank\" rel=\"noreferrer noopener\">Should All Game Wardens Wear Body Cams? Washington State Thinks So<\/a><\/p>\n<p class=\"article-paragraph skip\">West points to <a href=\"https:\/\/codes.findlaw.com\/pa\/title-30-pacsa-fish\/pa-csa-sect-30-901\/\" rel=\"nofollow noreferrer noopener\" target=\"_blank\">a Pennsylvania statute<\/a> that deals specifically with the Pennsylvania Fish and Boat Commission, and which grants the state\u2019s waterways conservation officers the power to \u201center upon any land or water in the performance of their duties.\u201d This is different, she explains, from a separate statute that allows Pennsylvania game wardens to enter upon any land except \u201ccurtilage,\u201d which is defined as the property immediately surrounding someone\u2019s home (such as their yard).\u00a0<\/p>\n<p class=\"article-paragraph skip\">West adds that there are a few states that have similar statues, although she was unable to specify which ones. She says that to her knowledge, these states don\u2019t grant the same kind of \u201cunlimited authority\u201d that Pennsylvania does.<\/p>\n<p class=\"article-paragraph skip\">\u201cWhen it comes to waterway conservation officers, this statute doesn\u2019t [enforce] the same limitations that even the state\u2019s game wardens have, so it\u2019s essentially giving them a blank check to go wherever, whenever, to look for some kind of wrong doing,\u201d West says. \u201cBut you don\u2019t lose your constitutional rights just because you happen to live near water.\u201d<\/p>\n<p class=\"article-paragraph skip\">West says they have not yet heard back from the PFBC, which has 60 days to respond to the complaint.<\/p>\n<\/p><\/div>\n<p><br \/>\n<br \/><a href=\"https:\/\/www.outdoorlife.com\/conservation\/pennsylvania-fish-cop-lawsuit\/\">Source link <\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A federal lawsuit filed Monday against the Pennsylvania Fish and Boat Commission seeks to strike down a state law that gives PFBC officers broad authority to conduct warrantless searches on private land.
