Gun Owners of America\u00a0has obtained an email from the FBI regarding changes to the NICS background check system to implement gun control.<\/p>\n
On Monday, September 26, 2022, federal firearms licensees (FFL) will experience\u2026 new features of the FBI’s NICS transaction process. One\u2026 change is tied to the passage of the NICS Denial Notification Act of 2022.<\/strong><\/p>\n Collection of Buyer’s Address\u2014<\/em><\/strong><\/u>\u00a0The NICS Denial Notification Act of 2022 requires the FBI’s NICS Section to notify state, local, or tribal law enforcement of all FBI NICS denied transactions within 24 hours. The FBI must provide notification to law enforcement based upon the location of the FFL and if different, the\u00a0<\/em>purchaser’s address<\/em><\/strong>. To support the determination of what local agency should receive the notification, FFLs will be required to provide the buyer’s complete address to NICS<\/strong> as recorded on the Bureau of Alcohol, Tobacco, Firearms and Explosives Form 4473 when transactions are denied or delayed<\/strong>. The address information will be required before the status can be provided or retrieved either by the NICS contracted call center or via the NICS E-Check.\u00a0<\/em><\/p>\n<\/blockquote>\n <\/a><\/p>\n That matches up closely with the\u00a0NICS Denial notification act<\/a>, which read:<\/p>\n “If the national instant criminal background check system\u2026provides notice\u2026 that” a transferee is prohibited person then the DOJ shall “report to the local law enforcement [and] the State or Tribe of residence of the person\u2014\u2026 within 24 hours”\u00a0<\/em><\/p>\n<\/blockquote>\n This change\u00a0would require<\/strong>\u00a0that an investigation be launched into\u00a0every background check denial<\/strong>, even though\u00a0nine times out of 10<\/strong>, the NICS system\u00a0has falsely denied<\/a>\u00a0law-abiding citizens from exercising their rights.<\/p>\n This is a significant change to the system<\/u><\/strong>, as, before the passage of the NICS denial notification act, dealers\u00a0were only required to provide the state of residence of a customer<\/em>. Now they will have to provide the transferee’s\u00a0full address<\/strong><\/u>\u00a0after the NICS system processes the background check\u00a0in the event of a delay or denial<\/strong>.<\/p>\n Delays in background checks are\u00a0extremely common<\/strong>.
