Because the system is broken and often mismatches law-abiding citizens with the<\/span> <span dir=\"ltr\" role=\"presentation\">records of convicted felons who share things like names and birthdays. This disproportionately affects minorities, such as<\/span> <span dir=\"ltr\" role=\"presentation\">Blacks and Hispanics, who are statistically more likely to share names and therefore are more likely to get a false<\/span> <span dir=\"ltr\">positive.<\/span><\/span><span id=\"page100R_mcid11\" class=\"markedContent\"><\/span><sup><a href=\"#_ftn1\" name=\"_ftnref1\">i<span id=\"page100R_mcid12\" class=\"markedContent\"><\/span><\/a><\/sup><\/p>\n<p><span id=\"page100R_mcid2\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">According to published FBI data, NICS has denied 44,223 prospective gun purchasers between November 30, 1998 and<\/span> <span dir=\"ltr\">December 31, 2022 for being \u201cIllegal\/Unlawful Alien[s]\u201d under 18 U.S.C. 922(g)(5).<\/span><\/span><span id=\"page100R_mcid13\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><sup><a href=\"#_ftn2\" name=\"_ftnref2\">ii<\/a><\/sup><\/span><\/span><span style=\"text-decoration: underline\"><span id=\"page100R_mcid29\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">While a proponent of the bill may<\/span><\/span><span id=\"undefined\" class=\"markedContent\"><\/span><span id=\"page100R_mcid30\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">say these are prohibited persons who were stopped from illegally purchasing a firearm, in reality these are \u201cinitial<\/span><\/span><span id=\"undefined\" class=\"markedContent\"><\/span><span id=\"page100R_mcid31\" class=\"markedContent\"> <span dir=\"ltr\">denials\u201d\u2014over 90% of which are false positives.<\/span><\/span><span id=\"page100R_mcid15\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><a href=\"#_ftn3\" name=\"_ftnref3\"><sup>iii<\/sup><\/a><\/span><\/span><span id=\"page100R_mcid32\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">This means that 9 out of 10 times these denials were almost certain<\/span><\/span><span id=\"undefined\" class=\"markedContent\"><\/span><\/span><span id=\"page100R_mcid33\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\"><span style=\"text-decoration: underline\">law-abiding Americans.<\/span> Gun purchasers who are falsely denied a background check are not dangerous or able to be<\/span><\/span><span id=\"undefined\" class=\"markedContent\"><\/span><span id=\"page100R_mcid34\" class=\"markedContent\"> <span dir=\"ltr\">prosecuted, which is why only a few dozen cases are even prosecuted by the Department of Justice each year.<\/span><\/span><span id=\"page100R_mcid17\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><sup><a href=\"#_ftn4\" name=\"_ftnref4\">iv<\/a><\/sup><\/span><\/span><span id=\"page100R_mcid18\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">In fact,<\/span> <span dir=\"ltr\" role=\"presentation\">DOJ deems these cases \u201cnot appealing to judges and juries from a public safety standpoint.\u201d<\/span><\/span><span id=\"page100R_mcid19\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><sup><a href=\"#_ftn5\" name=\"_ftnref5\">v<\/a><\/sup><\/span><\/span><span id=\"page100R_mcid20\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">When taken to trial,<\/span> <span dir=\"ltr\">background check denial cases often result in \u201cjuries refusing to convict these individuals or jury nullification.\u201d<\/span><\/span><span id=\"page100R_mcid21\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><sup><a href=\"#_ftn6\" name=\"_ftnref6\">vi<\/a><\/sup><\/span><\/span><span id=\"page100R_mcid35\" class=\"markedContent\"> <\/span><\/p>\n<p><span style=\"text-decoration: underline\"><span id=\"page100R_mcid35\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">GOA members want to see minority access to firearms protected and the badly broken National Instant Criminal<\/span><\/span><span id=\"undefined\" class=\"markedContent\"><\/span><span id=\"page100R_mcid36\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">Background Check System (NICS) repealed, not hyper-enforced.<\/span><\/span><\/span><span id=\"undefined\" class=\"markedContent\"><\/span><span id=\"page100R_mcid4\" class=\"markedContent\"><\/span><\/p>\n<h2 style=\"text-align: center\"><span id=\"page100R_mcid4\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Unintended Consequences of<\/span> <span dir=\"ltr\" role=\"presentation\">Illegal Alien NICS Alert Act<\/span> <span dir=\"ltr\" role=\"presentation\">Enforcement<\/span><\/span><span id=\"page100R_mcid5\" class=\"markedContent\"><\/span><\/h2>\n<p><span id=\"page100R_mcid5\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">It is absurd to imagine that a member of MS-13, illegally present in the United States, would go to Mom and Pop\u2019s gun<\/span> <span dir=\"ltr\" role=\"presentation\">store and fill out an FBI background check form to attempt to buy a gun legally when the vast majority of criminals<\/span> <span dir=\"ltr\">purchase their firearms illegally<\/span><\/span><span id=\"page100R_mcid23\" class=\"markedContent\"><\/span><a href=\"#_ftn7\" name=\"_ftnref7\"><sup>vii<\/sup><\/a><span id=\"page100R_mcid24\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">and a GAO study proved that using a fake ID to pass a background check worked 100%<\/span> <span dir=\"ltr\">of the time.<\/span><\/span><span id=\"page100R_mcid23\" class=\"markedContent\"><\/span><a href=\"#_ftn8\" name=\"_ftnref8\"><sup>viii<\/sup><\/a><\/p>\n<p><span id=\"page100R_mcid37\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">On the other hand, <span style=\"text-decoration: underline\">the brokenness of the background check system and the recent increase in minority gun ownership<\/span><\/span><\/span><span id=\"undefined\" class=\"markedContent\"><\/span><span id=\"page100R_mcid38\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\"><span style=\"text-decoration: underline\">suggest that many minorities are falsely denied their Second Amendment rights every year.<\/span> It is not so hard to imagine the<\/span><\/span><span id=\"undefined\" class=\"markedContent\"><\/span><span id=\"page100R_mcid39\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">FBI denying a gun purchaser their background check because they shared a name and a birthday with a criminal in a<\/span> <span dir=\"ltr\" role=\"presentation\">Department of Homeland Security database. <span style=\"text-decoration: underline\">Under the<\/span><\/span><span style=\"text-decoration: underline\"> <span dir=\"ltr\" role=\"presentation\">Illegal Alien NICS Alert Act<\/span><span dir=\"ltr\" role=\"presentation\">, law-abiding American citizens would<\/span><\/span><\/span><span style=\"text-decoration: underline\"><span id=\"undefined\" class=\"markedContent\"><\/span><span id=\"page100R_mcid40\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">not only be denied their Second Amendment rights, but also be reported to Immigration and Customs Enforcement for<\/span><\/span><span id=\"undefined\" class=\"markedContent\"><\/span><span id=\"page100R_mcid41\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">deportation.<\/span><\/span><\/span><span id=\"undefined\" class=\"markedContent\"><\/span><span id=\"page100R_mcid7\" class=\"markedContent\"><\/span><\/p>\n<h2 style=\"text-align: center\"><span id=\"page100R_mcid7\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Expanding Background Checks Will Not Solve the Border Crisis<\/span><\/span><\/h2>\n<p><span id=\"page100R_mcid8\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">The<\/span> <span dir=\"ltr\" role=\"presentation\">Illegal Alien NICS Alert Act<\/span> <span dir=\"ltr\" role=\"presentation\">is a distraction from the major issues regarding immigration and the border and will not<\/span> <span dir=\"ltr\" role=\"presentation\">solve any of them. Congress will not fix the ongoing border crisis by expanding the FBI\u2019s enforcement of firearm<\/span> <span dir=\"ltr\" role=\"presentation\">purchase background check denials. Instead, this legislation would legitimize a system that punishes American citizens<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">wishing to exercise their Second Amendment rights<\/span><span dir=\"ltr\" role=\"presentation\">.<\/span><\/span><span id=\"page100R_mcid9\" class=\"markedContent\"><\/span><\/p>\n<p><span style=\"text-decoration: underline\"><span id=\"page100R_mcid9\" class=\"markedContent\"><span dir=\"ltr\">The Second Amendment does not apply to illegal aliens, as they do not contribute to the \u201csecurity of a free state.\u201d<\/span><\/span><span id=\"page100R_mcid23\" class=\"markedContent\"><\/span><a href=\"#_ftn9\" name=\"_ftnref9\"><sup>xi<\/sup><\/a> <span dir=\"ltr\" role=\"presentation\">However, the<\/span> <span dir=\"ltr\" role=\"presentation\">Illegal Alien NICS Alert Act<\/span> <span dir=\"ltr\" role=\"presentation\">will likely have a negative impact on legal immigrants\u2019 and U.S. citizens\u2019 right<\/span><\/span><span id=\"undefined\" class=\"markedContent\"><\/span><span id=\"page100R_mcid44\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">to purchase firearms. Over time, enforcement of such a provision could have a chilling effect on the decisions by members<\/span><\/span><span id=\"undefined\" class=\"markedContent\"><\/span><span id=\"page100R_mcid45\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">of minority communities to commercially purchase firearms.<\/span><\/span><span id=\"undefined\" class=\"markedContent\"><\/span><span id=\"page100R_mcid10\" class=\"markedContent\"> <\/span><\/p>\n<p><span id=\"page100R_mcid10\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">If Congress tweaks a bad law on the books, not only will it legitimize a bad system, but ICE officers will be encouraged to<\/span> <span dir=\"ltr\" role=\"presentation\">harass law-abiding citizens to prove their immigration status. This would do nothing to solve crimes, make our<\/span> <span dir=\"ltr\" role=\"presentation\">communities safer, or protect the lives of innocent Americans.
