Permitless carry in Nebraska would solve a lot of these issues.\u201d <\/i><\/b><\/h3>\n<h3 style=\"text-align: center\"><b><i>Tom Knighton, <\/i><\/b><b><i>BearingArms, March 6, 2023<\/i><\/b><\/h3>\n<hr \/>\n<p>Constitutional Carry is moving in Nebraska, where two Democrats have broken with the party line to support the bill.<\/p>\n<p>As to the \u201cwhy\u201d these two Democrats are supporting permitless carry, the <em><a href=\"https:\/\/www.msn.com\/en-us\/news\/politics\/permitless-concealed-carry-gun-bill-advances-in-nebraska\/ar-AA18c0aD\" target=\"_blank\" rel=\"noopener\">Associated Press provides the answer<\/a><\/em>:<\/p>\n<p style=\"padding-left: 40px\">While the bill would not usurp the federal requirement for a background check to buy a gun, it would allow people to carry guns hidden in their clothing or vehicle without having to pay for a government permit or take a now-required gun safety course. It also would override stricter gun laws in the state\u2019s cities, including in the state\u2019s largest city of Omaha, which requires a conceal carry license for anyone carrying a gun in a car \u2014 even if the gun is in open view.<\/p>\n<p style=\"padding-left: 40px\">It\u2019s that Omaha law that spurred Omaha Sens. Justin Wayne and Terrell McKinney to break party ranks and support the bill.<\/p>\n<p style=\"padding-left: 40px\">\u201cHow many young African American and Latino kinds are affected by Omaha\u2019s gun laws?\u201d asked Wayne on the Senate floor. Young Black people in Omaha are often charged with gun possession violations when a gun that\u2019s not theirs is found in a car they\u2019re riding in, Wayne said.<\/p>\n<p style=\"padding-left: 40px\">The practice, known in law enforcement circles as \u201cbumping up,\u201d disproportionally affects people of color, he said.<\/p>\n<p style=\"padding-left: 40px\">\u201cWhen they\u2019re talking about bumping up kids in Omaha, they\u2019re not talking about kids in Bennington,\u201d Wayne said, referring to the overwhelmingly white bedroom community north of Omaha. \u201cThey\u2019re not talking about kids in western Nebraska.\u201d<\/p>\n<p style=\"padding-left: 40px\">McKinney said the creation of early gun control laws in the U.S. \u201cwas out of fear of Black people.\u201d<\/p>\n<p>In commenting on this, <a href=\"https:\/\/bearingarms.com\/tomknighton\/2023\/03\/06\/black-dems-nebraska-n68067?utm_source=badaily&amp;utm_medium=email&amp;utm_campaign=nl&amp;bcid=c7c121d11e36237f9e543ec9c3cb4c485a91cb9a88d314180f6cdcd80750f74f\" target=\"_blank\" rel=\"noopener\"> Tom Knighton of <em>BearingArms<\/em> explains that<\/a>, \u201cBoth Wayne and McKinney are also right when they point out that gun control laws, such as the one in Omaha, disproportionately impact black men.<\/p>\n<p>\u201cNow, is that due to racist design, racist application of the law, or some factor that has nothing to do with race? That\u2019s a matter of debate, I\u2019m sure, but the point remains that the law does disproportionately hit Nebraska\u2019s black community compared to white people.<\/p>\n<p>\u201cAnd if that\u2019s the reason they want to support permitless carry, I\u2019m all for it.<\/p>\n<p>\u201cLook, criminals are already carrying guns without permits. They\u2019ve been doing it for a very long time. However, Nebraska\u2019s permitting requirements make it a challenge for law-abiding people to even get a permit. Sure, it may not have been New York or California\u2019s pre-Bruen requirements, but when people have to travel significant distances just to apply for a permit, you\u2019ve got an issue.<\/p>\n<p>\u201cPermitless carry in Nebraska would solve a lot of these issues.\u201d<\/p>\n<p>Knighton says that the reasons these two Senators are supporting Constitutional Carry is not surprising. Moreover, \u201cif more black Democrats and activists made this particular stand as well, it would be interesting to see the shift in gun control discussions going forward.\u201d<\/p>\n<p>Knighton concludes: \u201cDemocrats often claim a law is racist if it seems to jam up black people more often than white folks, yet tend to ignore this fact when it comes to guns.
