\n<\/p>\n
According to President Biden, \u201cover $231 million will fund state\u2026 extreme risk protection order (ERPO) programs.\u201d[i]<\/a> This is being accomplished through the Byrne State Crisis Intervention Program, which was created by the Bipartisan Safer Communities Act <\/em>or Cornyn-Murphy compromise to weaponize Edward Byrne Memorial Justice Assistance Grants into an unconstitutional \u201cred flag\u201d gun confiscation order (GCO) program.[ii]<\/a><\/p>\n The 118th<\/sup> Congress must undo the 117th<\/sup>\u2019s mistake and live up to their oath to protect and defend the Constitution.<\/u> For the protection of the millions of gun-owning citizens in all states and territories, Congress must pass Congresswoman Lauren Boebert\u2019s Shall Not Be Infringed<\/em> Act<\/strong> and repeal all Cornyn-Murphy gun control. In addition, these gun confiscation law subsidies must be defunded.<\/strong><\/p>\n In the summer of 2022, Congress rammed through an atrocious gun control bill without a serious understanding of its effects. Texas Senator John Cornyn, the lead GOP negotiator of this compromise, downplayed its effects, stating that:<\/p>\n If a state chooses to use any of this funding to implement an extreme risk protection order program, it would be required to meet strict and expansive due process, evidentiary, and standard of proof requirements\u2026 This bill would\u00a0force states with red flag laws to adopt strict and comprehensive due process protections<\/strong>\u00a0before they qualify for the grant funding.[iii]<\/strong><\/a><\/em><\/p>\n But the promises of due process were never based on substance because no matter what requirement needed to happen to qualify, the bill text and final legislative language stated: \u201cdue process\u201d must occur \u201cat the appropriate phase.\u201d[iv]<\/a> This effectively undermined any requirement of pre-rights deprivation due process. Whatever due process safeguards were promised can simply occur at a \u201cphase\u201d after<\/em> guns have been seized. This phrasing is reaffirmed in the Byrne State Crisis Intervention Program (SCIP) FAQ page.[v]<\/a> GOA raised the alarm on this provision before the bill was passed.[vi]<\/a><\/p>\n GOA analyzed the Biden Administration\u2019s disbursal of \u201cred flag\u201d gun confiscation grants pursuant to the Bipartisan Safer Communities Act <\/em>and found that the \u201cdue process\u201d protections secured by Senators Cornyn and Murphy were as worthless as we suspected. The grant program funded every single gun confiscation law across the nation and then some. Only 20 states and D.C. have gun confiscation laws. Yet, Biden announced that 25 states, 3 territories,[vii]<\/a> and D.C. received funding that either have pre-existing gun confiscation laws or explicitly mentioned GCOs in their grant proposals, despite not having a qualifying law on the books:<\/p>\n Arizona, Arkansas, California, Colorado, Connecticut, Delaware, District of Columbia, Florida, Guam, Hawaii, Illinois, Indiana, Kansas, Maryland, Massachusetts, Maine, Nevada, Minnesota, New Jersey, New Mexico, New York, Oregon, Puerto Rico, Rhode Island, Vermont, Virginia, Virgin Islands, Washington, and West Virginia.<\/p>\n At least 12 other states are receiving grant funding to broadly implement \u201ccrisis\u201d laws without specifically mentioning \u201cred flag\u201d laws:<\/p>\n Kentucky, Louisiana, Missouri, , New Hampshire, North Carolina, Oklahoma, Pennsylvania, South Carolina, Tennessee, Texas, Utah, and Wisconsin.[viii]<\/a><\/p>\n Since the funding grants are given to study all forms of \u201ccrisis intervention\u201d proceedings, which includes GCOs under federal law, it is likely that anti-gunners receiving these grants will use them to advocate for gun control, even in states without such laws.<\/p>\n Courts, local and state governments, \u201csupervision agencies,\u201d rogue prosecutors, and even anti-gun universities are eligible to use funds from Cornyn-Murphy to help enact \u201cred flag\u201d gun confiscation laws.[ix]<\/a> Although there are promises that funds will not be used for lobbying the government, these provisions are a joke. Even if funds are not used to implement \u201cred flag\u201d laws by directly lobbying the government, nothing is preventing the funding of anti-gun propaganda being used to sway public opinion. In fact, according to Bureau of Justice Assistance (BJA) senior policy advisor Tammy Brown:<\/p>\n \u201cif the state does not have that law in place, it could be media campaigns or public service announcements that would encourage the state to incorporate that type of law.
