{"id":924,"date":"2023-03-12T23:28:45","date_gmt":"2023-03-12T23:28:45","guid":{"rendered":"https:\/\/americangunpeople.com\/?p=924"},"modified":"2023-03-12T23:28:45","modified_gmt":"2023-03-12T23:28:45","slug":"wy-the-state-of-gun-rights-in-wyoming","status":"publish","type":"post","link":"https:\/\/americangunpeople.com\/?p=924","title":{"rendered":"WY: The State of Gun Rights in Wyoming!"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<h3 style=\"text-align: center\"><strong>The 2023 Wyoming Legislative Session Recap &#8211; Much More Work Needs to be Done!<\/strong><\/h3>\n<p>The 2023 Wyoming Legislative Session came to an end on Friday, March 3, after a rocky ride for our Second Amendment Rights!<\/p>\n<div id=\"attachment_772078\" style=\"width: 304px\" class=\"wp-caption alignright\"><\/p>\n<p id=\"caption-attachment-772078\" class=\"wp-caption-text\">SF0120 Contained Hidden Gun Control<\/p>\n<\/div>\n<p>When it comes to gun issues, the 2023 Session contained some bad news and some good news.<\/p>\n<p><i><strong><u>FIRST THE BAD NEWS!<\/u><\/strong><\/i><\/p>\n<p>In the final week of the Session, GOA warned our members and supporters that the Wyoming Legislature was poised to pass\u00a0<strong>hidden gun control<\/strong>\u00a0in a bill labeled &#8220;Restoration of Civil Rights!&#8221;<\/p>\n<p>Despite a strong GOA-backed effort to amend this bill by pro-gun Representatives in the House,\u00a0<a href=\"https:\/\/www.votervoice.net\/BroadcastLinks\/-CoeRrE_6w6xF988d7hbuQ\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-safelink=\"true\" data-linkindex=\"0\">SF0120<\/a>\u00a0passed without critical amendments just before the Legislature adjourned on March 3.<\/p>\n<p>As passed, SF0120 restores the right to bear arms to one-time non-violent felons in Wyoming, which is a concept GOA supports.\u00a0<strong>However,\u00a0<\/strong><strong>SF0120 contains gun control provisions not necessary for restoring rights, and it actually revokes rights not previously revoked under Wyoming statutes.\u00a0<\/strong><\/p>\n<p>Essentially, the Wyoming Legislature revoked the firearms rights of\u00a0<u>non-violent<\/u>\u00a0felons under Wyoming law in order to restore them under Federal Law when there were other legal paths for restoring the rights of non-violent felons.\u00a0<strong>With two simple amendments, SF0120 could have been a true &#8220;Restoration of Civil Rights&#8221; bill, contained no gun control, and accomplished the same end result!<\/strong><\/p>\n<div id=\"attachment_771415\" style=\"width: 225px\" class=\"wp-caption alignright\"><img decoding=\"async\" aria-describedby=\"caption-attachment-771415\" loading=\"lazy\" class=\"wp-image-771415 \" src=\"https:\/\/www.gunowners.org\/wp-content\/uploads\/Repeal-Gun-Free-Zones.png\" alt=\"\" width=\"215\" height=\"215\" \/><\/p>\n<p id=\"caption-attachment-771415\" class=\"wp-caption-text\"><strong>HB0105 would have put our laws more in line with states like Idaho, Montana, South Dakota, and Utah<\/strong><\/p>\n<\/div>\n<p>While we are talking about bad news, early in the session, we were hopeful we could pass legislation to\u00a0<strong>repeal most of Wyoming&#8217;s remaining gun-free zones<\/strong>\u00a0(<a href=\"https:\/\/www.votervoice.net\/BroadcastLinks\/lvpxlhrWxuNzS0fSjPTp0A\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-safelink=\"true\" data-linkindex=\"1\">HB0105<\/a>\u00a0sponsored by Representative Haroldson [R] from Wheatland) and\u00a0<strong>stop Biden&#8217;s Red Flag money<\/strong>\u00a0(<a href=\"https:\/\/www.votervoice.net\/BroadcastLinks\/zx3gWCRRosRon_4C1L5kSg\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-safelink=\"true\" data-linkindex=\"2\">HB0250<\/a>\u00a0sponsored by Representative Jennings [R] from Sheridan). HB0205 would have complimented and enhanced the\u00a0<strong>GOA-backed Second Amendment Protection Act<\/strong>\u00a0which passed in 2022 &#8212; a law that already prohibits state and local participation in unconstitutional federal gun control.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>However, in early February, Wyoming House Speaker Albert Sommers [R] from Pinedale sent HB0105 and HB0250 to the anti-gun House Appropriations Committee.<\/strong><strong>\u00a0<\/strong>The Appropriations Committee first gutted both pieces of legislation by trying to pass &#8220;Substitute Bills&#8221; containing terrible language. Ultimately, both bills were stonewalled.<\/p>\n<p>Effectively, using a variety of hard-to-track processes,<strong>\u00a0Speaker Sommers and the Appropriations Committee kept both the Stop Red Flags Act and Repeal Gun-free Zones bills from getting a vote from your elected Representatives on the full House Floor.<\/strong><\/p>\n<div id=\"attachment_771420\" style=\"width: 238px\" class=\"wp-caption alignright\"><img decoding=\"async\" aria-describedby=\"caption-attachment-771420\" loading=\"lazy\" class=\" wp-image-771420\" src=\"https:\/\/www.gunowners.org\/wp-content\/uploads\/Stop-Red-Flag-Laws-e1674674760411.png\" alt=\"\" width=\"228\" height=\"228\" \/><\/p>\n<p id=\"caption-attachment-771420\" class=\"wp-caption-text\">HB0250 would have specifically stopped Biden&#8217;s Red Flag money from coming to the Cowboy State<\/p>\n<\/div>\n<p>This experience has taught us that we face serious challenges with House Leadership and at least one anti-gun Committee when it comes to passing important legislation to advance our Second Amendment Rights in Wyoming.<\/p>\n<p>Keep in mind that both the Repeal Gun-free Zones Bill and the Stop Red Flags Bill are in line with legislation already passed in other states.<strong>\u00a0The &#8220;Cowboy State,&#8221; under the leadership of the current Speaker and his Committees, is lagging behind other states in terms of standing up for our God-given Right to Keep and Bear Arms!<\/strong><\/p>\n<p><i><strong><u>NOW FOR SOME GOOD NEWS!<\/u><\/strong><\/i><\/p>\n<p>GOA-Backed\u00a0<a href=\"https:\/\/www.votervoice.net\/BroadcastLinks\/xfpLCkvwH4EORI8HgJq7hw\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-safelink=\"true\" data-linkindex=\"3\">SF0148<\/a>\u00a0passed both the Wyoming Senate and House and was signed into law by Governor Gordon on Monday, February 27! This bill fixes an error in Wyoming&#8217;s Statutes by restoring the intent of Wyoming&#8217;s Preemption law and stopping localities from passing more restrictive gun control than allowed by the state legislature.<\/p>\n<p><strong>This new law means a local Wyoming authority CANNOT pass restrictions on concealed carry, magazine size, or other legal firearms or firearms-related activities allowed under Wyoming law.\u00a0<\/strong>All authority to regulate firearms rests with the State Legislature.<\/p>\n<p>Another positive piece of legislation that passed was\u00a0<a href=\"https:\/\/www.votervoice.net\/BroadcastLinks\/mScL_ELMEECk5bxYXYSBaw\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-safelink=\"true\" data-linkindex=\"4\">HB0104<\/a>. This legislation removes unnecessary restrictions on night predator hunting that previously existed. Now, all public lands (over one-half of the Cowboy State) are subject to the same rules that already existed for private lands.<strong>\u00a0<\/strong><strong>This results in significantly increased hunter opportunity and access to places to hunt all across Wyoming.<\/strong><\/p>\n<p><strong><u>IN CLOSING\u00a0<\/u><\/strong><\/p>\n<p>The 2023 Wyoming Legislative Session was a story of wins and losses for the Second Amendment.<\/p>\n<p><strong>Wyoming continues to lag behind neighbors\u00a0<\/strong>like Idaho, Montana, South Dakota, and Utah in terms of gun-free zones. We failed to pass a law to enhance our SAPA and specifically stop Red Flag money like done in Oklahoma and West Virginia.<\/p>\n<p><strong>Our Legislature added gun control provisions to our Wyoming statutes\u00a0<\/strong>in order to &#8220;restore rights&#8221; to non-violent felons, even though those gun control provisions were not necessary for accomplishing that goal.<\/p>\n<div id=\"attachment_771936\" style=\"width: 236px\" class=\"wp-caption alignright\"><img decoding=\"async\" aria-describedby=\"caption-attachment-771936\" loading=\"lazy\" class=\" wp-image-771936\" src=\"https:\/\/www.gunowners.org\/wp-content\/uploads\/MicrosoftTeams-image-35.png\" alt=\"\" width=\"226\" height=\"268\" \/><\/p>\n<p id=\"caption-attachment-771936\" class=\"wp-caption-text\">A majority of the current Wyoming Legislature cannot be considered strong supporters of our Second Amendment Rights<\/p>\n<\/div>\n<p>On a positive note,\u00a0<strong>we strengthened Wyoming Statutes to prevent localities from passing gun control not authorized by the State Legislature<\/strong>, and we expanded hunter opportunities on public lands.<\/p>\n<p>Going forward, we have a lot of work to do before passing any meaningful legislation during the 2024 Session.<\/p>\n<p><strong>All Second Amendment advocates need to mobilize and demand more of our elected Representatives and Senators in 2024.\u00a0<\/strong>GOA will keep you informed and help lead the way on that mission!<\/p>\n<p>Be sure to keep in mind that 2024 is also another election cycle in Wyoming.\u00a0<strong>GOA will work hard to advance pro-Second Amendment Legislation during the next Legislative Session, and we will begin laying the groundwork for holding officials accountable during the 2024 election season.<\/strong><\/p>\n<p>Be on the lookout for more from GOA in the coming weeks and months as we continue to fight to protect the Second Amendment and advance hunter opportunities in the Cowboy State!<\/p>\n<p>&nbsp;<\/p>\n<p>P.S.
